IN THE EVENT THAT RCI AND/OR ANY INDEMNITEE IS FOUND TO BE LIABLE FOR ANY DAMAGES, THE TOTAL AMOUNT OF DAMAGES A MEMBER OR GUEST MAY RECOVER SHALL BE LIMITED TO THE AMOUNT OF SUBSCRIPTION FEES AND OTHER FEES THAT SUCH MEMBER ACTUALLY HAS PAID TO RCI DURING THE ANNUAL MEMBERSHIP YEAR IN WHICH THE LIABILITY AROSE.
